Senior Partner Mr. Haitao SHA attended and spoke at the Global Automotive Intellectual Property Summit

The Global Automotive Intellectual Property Summit (GAIPS 2023) was successfully held in Shanghai Longemont Hotel from May 10 to 12, 2023, hosted by YIP Events & IP ForeFront. Focused on the theme of “IP Protection and Risk Control to Promote Automotive Innovation and Development”, GAIPS 2023 attracted leading domestic and foreign automotive enterprises, auto parts suppliers, intelligent network field and IP lawyers, scholars and experts, with nearly 500 practitioners participating in the summit either online or offline. The participants expressed their views mainly on a series of topics related to automotive IP, such as exploring the SEP licensing model in China, the development trend and risks of automotive IP from a global perspective, topical issues of automotive SEP, and challenges of and responses to new energy automotive IP.

Mr. Haitao SHA, Deputy Director of Intellectual Property Practice Research Committee of Shanghai Bar Association and Senior Partner of JT&N, was invited to participate in the pre-summit discussion “Building, Challenges and Risks of Standard-essential Patent Licensing in the ICV Industry” and speak as a guest at the roundtable.

Focusing on the topic of “Building, Challenges and Risks of Standard-essential Patent Licensing in the ICV Industry”, Mr. SHA pointed out that the ICV industry would soon become a hot spot for standard-essential patent disputes, and there was much controversy over the reasonableness of both the current licensing model for whole vehicles and the licensing fee rates adopted by Avanci, a standard essential patent pool organization. Mr. SHA further shared JT&N’s experience of representing TCL in its standard essential patent dispute with Ericsson. When representing that case, JT&N facilitated the settlement of the global patent dispute between TCL and Ericsson by activating the anti-monopoly investigation against Ericsson by the Chinese anti-monopoly investigation authority and initiating anti-monopoly and anti-unfair competition lawsuits and other countermeasures. The standard essential patent issue in the ICV industry today presents both opportunities and challenges, and all parties concerned should work together to build a fair and reasonable standard essential patent licensing and dispute resolution mechanism, so as to promote healthy interaction and integrated development among various industries.
