 On March 3, 2023, the 2022-2023 Review and Case Sharing Meeting on Pharmaceutical and Healthcare Compliance/Litigation Hotspots, sponsored by JT&N and co-organized by Wolters Kluwer and Healthcare Executive Magazine, was s held in Lujiazui, Shanghai. Participants in the meeting included leaders of the Shanghai Biopharmaceutics Industry Association, legal experts and professors specializing in the pharmaceutical and healthcare field, and legal/compliance personnel of leading pharmaceutical and healthcare companies including 3M, Bausch + Lomb, Philips, Fosun Pharmaceutical, Abbisko Therapeutics, CBC Group, WeDoctor and Ezisurg Medical.

Attorney Ye Lelei, Director of the JT&N Shanghai Office, delivered opening remarks, summarizing the development of compliance and related rules and regulations in China’s pharmaceutical and healthcare industry from a macro perspective, and describing JT&N’s comprehensive capacity to provide legal services support to the pharmaceutical and healthcare sector.

Attorney Yang Chen, Director of JT&N, provided examples of overseas litigation cases involving Chinese pharmaceutical companies that he had represented, discussing specific issues encountered in litigation and their solutions, including anti-monopoly issues arising from price alliances of Chinese pharmaceutical companies and cross-border data security assessment issues arising from the transfer of relevant litigation materials outside of China. The content shared by Attorney Yang was very well received by the legal and compliance personnel of the represented pharmaceutical companies.

JT&N Partners Cai Junxiang and Dai Junda delivered speeches on the topic of pharmaceutical and healthcare industry compliance, including comments on new laws, interpretation of hot topics and sharing of typical cases, discussing anti-corruption, anti-fraud, anti-trust, trade secret protection, biosafety, medical ethics review, pharmaceutical and healthcare advertising compliance, Internet diagnosis and treatment, medical data protection, online drug sales, and other aspects of the pharmaceutical and healthcare industry.

In addition, Attorney Sun Tashi from Paul Hastings, a leading U.S. law firm, discussed compliance highlights and typical cases of Chinese pharmaceutical and healthcare companies in China involving American business, and highlighted the application and enforcement of the U.S. Foreign Corrupt Practices Act (FCPA) at the meeting.

JT&N also invited five legal/compliance officers from well-known Chinese and foreign pharmaceutical and healthcare companies to share their real-life compliance experiences, providing valuable insights to all of the attendees.

The meeting came to a close with a round of warm applause. The host, Attorney Cai Junxiang, expressed his sincere thanks and best wishes to all the guests and meeting staff.
